Prices posted on this website are subject to change without notice. Written estimates are good for 30 days. An estimate not accepted within 30 days may be changed.

Right To Refuse

Project Fuel reserves the right to use its sole discretion in refusing to work on anything it deems improper or known to be illegal. We are not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The Client guarantees the legal title of all matter submitted to Project Fuel for design.

Demonstration Rights
Project Fuel has the right to show the Client's finished work for promotional purposes. If the work is not completed, limited portions my be shown or work must be completed, depending on what the Client wants.

Confidential Information
Project Fuel acknowledges and agrees that the source materials and technical and marketing plans or other sensitive business information, as specified by the Client, including all materials containing said information, that are supplied by the Client to Project Fuel or developed by Project Fuel in the course of developing the Website/Design are to be considered confidential information. Information shall not be considered confidential if it is already publicly known through no act of the Project Fuel.

Unauthorized Use and Program Licenses
The Client will indemnify Project Fuel against all claims and expenses arising from uses for which the Client does not have rights to or authority to use. The Client will be responsible for payment of any special licensing or royalty fees resulting from the use of graphics programs that require such payments. Project Fuel is held harmless from damages or liability in actions brought by third parties. Any and all costs and expenses that might arise from a judgment are the responsibility of the Client.

Indemnification

The Client represents that it has the legal right to produce all materials ordered from Project Fuel. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Project Fuel based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the product produced by Project Fuel ordered by the Client: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the Client shall indemnify and hold Project Fuel harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Project Fuel against any such Claim (2.) paying any judgment or award against the Client; and (3.) reimbursing Project Fuel for any legal fees and expenses it reasonably incurs in responding.

Warranty of Originality

Project Fuel warrants and represents that, to the best of it’s knowledge, the work assigned hereunder is original and has not been previously published, or that consent to use has not been obtained on an unlimited basis; that all work or portions thereof obtained through the undersigned from third parties is original or, if previously published, that consent to use has been obtained on an unlimited basis; that Project Fuel has full authority to make this agreement; and that the work prepared by Project Fuel does not contain any scandalous, libelous, or unlawful matter. This warranty does not extend to any uses that the Client or others may make of Project Fuel’s product that may infringe on the rights of others. CLIENT EXPRESSLY AGREES THAT IT WILL HOLD PROJECT FUEL HARMLESS FOR ALL LIABILITY CAUSED BY THE CLIENT'S USE OF PROJECT FUEL'S PRODUCT TO THE EXTENT SUCH USE INFRINGES ON THE RIGHTS OF OTHERS.
